About BallotLink
BallotLink is an HOA election management platform operated by NextGen Campaigns (NGC), based in California. We provide digital election services to Homeowners Associations (HOAs) in compliance with California Civil Code §5105 (Davis-Stirling Act).
Information We Collect
We collect only the information necessary to administer your HOA's elections. This may include:
- Your name and email address (provided by your HOA)
- A unique ballot key assigned to each eligible voter
- Technical information such as IP address and browser type for security and audit purposes
We do not collect payment information, Social Security numbers, or any information beyond what is required to conduct a legally compliant HOA election.
How We Use Your Information
Your information is used exclusively to:
- Verify your eligibility to vote in your HOA's election
- Deliver your ballot securely
- Record and tally votes in accordance with California law
- Fulfill record-keeping requirements under California Civil Code §5125
We Do Not Sell or Share Your Personal Information
BallotLink and NextGen Campaigns do not sell, rent, lease, or share your personal information with any third party for marketing or commercial purposes. This applies to all users — HOA members, board members, management companies, and Inspectors of Elections.
Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), you have the right to:
- Know what personal information we collect about you
- Request deletion of your personal information
- Opt out of the sale or sharing of personal information (we do not sell or share, so this right is already satisfied)
- Non-discrimination for exercising your privacy rights
Data Retention
Election records, including ballot data, are retained in accordance with California Civil Code §5125, which requires HOAs to retain election materials for at least one year following the election. All personal data is deleted one year after the conclusion of the election.
Security
BallotLink uses industry-standard security measures to protect your information, including encrypted transmission (HTTPS), unique ballot keys to ensure secret ballot integrity, and access controls that restrict data to authorized personnel only.
Third-Party Services
BallotLink uses Amazon Web Services (AWS) for email delivery. Ballot emails are transmitted through AWS Simple Email Service (SES). AWS's privacy practices are governed by their own privacy policy. No voter data is stored with AWS beyond what is required for transmission.
